Benefits Of US Implementation Of The Hague Agreement

By: Michael J. Leonard and John P. Sullivan

Publication: Law 360

January 11, 2013 — President Obama recently signed into law the Patent Law Treaties Implementation Act of 2012 (U.S. Bill S.3486), which goes into effect in December 2013. The law will allow U.S. citizens and residents to participate in the existing international filing system for design patents via the Hague System Agreement. Upon implementation, U.S. applicants will be able to more efficiently secure protection for industrial designs abroad. In addition, international owners of design rights can more fully avail themselves of a simplified filing mechanism for securing protection of their designs in the United States. Publication: The Legal Intelligencer

On December 18, 2012, President Obama signed a bill (U.S. Bill S.3486, referred to as “Patent Law Treaties Implementation Act of 2012”) that will allow U.S. citizens and residents to participate in an existing international filing system for design patent applications known as the Hague Agreement. The system is similar to the well-known international filing system (the Patent Cooperation Treaty, often referred to as “PCT”) for utility patent applications. The new law will not be in effective until December 2013. Click here to view whole article.
